Attitudes to workplace monitoring differ depending on country and workplace culture (see our articles: Looming lockdowns and remote working – to what extent can employees be monitored?, Record €35 million fine for excessive employee monitoring and Ius Laboris’ report Monitoring in the workplace). Post-pandemic some companies have embraced remote and flexible working, realising presenteeism doesn’t mean productivity, while others most definitely have ‘trust’ issues, for example taking screenshots of employees work, turning on cameras and microphones or even monitoring employees social media feeds. Whilst a lot of such monitoring can be lawful, proportionate and reasonable there is always a balance to be struck and care needs to be taken to ensure you are on the right side of the line.
